A Contra Costa jury has determined the 20-year-old accused of torturing and murdering Martinez teen Eric Bean in 2009 is mentally competent to stand trial, despite claims by his attorney and a psychologist that Timothy Danny Delosreyes III's cognitive disabilities should exclude him from criminal prosecution.
Delosreyes's attorney G. Wright Morton said in a phone interview Wednesday that he was hoping his client would be found mentally incompetent to stand trial – incapable of understanding the proceedings against him and unable to assist in his own defense – during a competency jury trial held April 25-28.

Sheriff's Office investigators determined Doe's body had been buried at the location for over a year and the woman had been killed by blunt force trauma to the head.
Forensic deputies recently completed a DNA profile of the woman's remains and tried unsuccessfully to locate her in national law enforcement missing persons databases.

The twelve men and women charged with deciding whether Robert Gardner is guilty or innocent of first-degree murder and other charges retired to a Contra Costa County jury room Tuesday afternoon to begin their deliberations.
Both the prosecutor and defense attorney in the first trial of an accused killer of Martinez teen Eric Bean delivered closing arguments during the morning court session. Contra Costa Deputy District Attorney Jason Peck reiterated his accusations that Gardner, a former Benicia resident, fully participated in the torture and murder of Bean in 2009, titling his final PowerPoint presentation to the jury, "Snitches End Up in Ditches."
